FOLLOWING THE RULES

I agree to follow all posted rules, signs, and instructions, and to comply with any directions given by staff, employees, or representatives of Resolute Property Investment and Collbran Vacation Rentals.

PROPERTY DESCRIPTION AND GUEST SUITABILITY

I acknowledge that Collbran Vacation Rentals and Resolute Property Investments LLC make every effort to maintain a safe environment and to accurately describe and represent the properties, including features, amenities, access conditions, terrain, and surrounding environmental factors. This information is provided so I can make an informed decision about whether the property is suitable for my stay, consider any risks in advance, and determine whether I am able to safely use and stay on the property. By reserving a stay, I acknowledge that I and my guests are suitable for the property and its conditions and that we have considered and accepted any risks associated with our stay. 

RISKS AND RELEASE OF LIABILITY

I understand that staying at a vacation rental property involves inherent risks, just like any outdoor or recreational activity, and I accept full responsibility for any injuries, accidents, losses, or damage that may occur to me or anyone in my group. These risks may include, but are not limited to, driving on roads that may have adverse or changing conditions; walking or hiking on terrain that may be uneven or slippery; using propane/ natural gas heaters, fire pits, and BBQs; using stairs and unrailed decks; encountering wildlife or domestic pets; experiencing weather conditions; being near open water; and experiencing other natural or man-made hazards. 

I voluntarily assume all such risks and release Resolute Property Investments LLC and Collbran Vacation Rentals from any legal responsibility for injuries, death, property damage, or other losses suffered by me, my guests, or our belongings while on or around the property, whether caused by our actions, the actions of others, or the acts or omissions of Resolute Property Investments LLC, Collbran Vacation Rentals, or their representatives. 

RESPONSIBILITY OF LEGAL CLAIMS

If someone makes a claim or files a lawsuit related to my or my group’s stay, I agree to cover any costs, including legal fees, that Resolute Property Investments LLC or Collbran Vacation Rentals might face because of it.

DAMAGE

I agree to pay for any damage caused by me or my group — whether it’s by accident, recklessness, or intentional actions.

LEGAL JURISDICTION

If a legal dispute arises, it will be handled under the laws of the State of Colorado.

VOLUNTARY AGREEMENT

I am signing this agreement voluntarily and without any pressure. I’ve had enough time to read and understand it, and I know that I can ask a lawyer to review it if I choose. If I decide not to sign, Resolute Property Investments LLC and Collbran Vacation Rentals will cancel the reservation and dissolve this agreement at no cost to me.

NO FAVORITISM IN INTERPRETATION AND VALIDITY

This agreement has been fairly negotiated. If any part of it is unclear, neither side will get an advantage just because they did or didn’t write the original wording. If any section of this agreement is found to be invalid or unenforceable, the rest of the agreement still applies.

DISPUTES

If there’s a disagreement, both sides agree to first try to resolve it through calm and respectful conversation. If that doesn’t work, we’ll try mediation with a neutral third party who will help us reach a fair agreement. If mediation doesn’t work, either side is free to explore other legal options allowed by law.
