READ CAREFULLY - THIS AFFECTS YOUR LEGAL RIGHTS

In exchange for staying at a property owned by Resolute Property Investments LLC or managed and/or owned by Collbran Vacation Rentals, I agree to the following terms for myself and (if applicable) the other members of my group:

1. FOLLOWING THE RULES

I agree to follow all posted rules, signs, and instructions, and to comply with any directions given by staff, employees, or representatives of Resolute Properties and Collbran Vacation Rentals.

2. RISKS AND RELEASE OF LIABILITY

I understand that staying at the property involves some risks (just like any activity), and I accept full responsibility for any injuries or damage that might happen to me or anyone in my group. I release Resolute Property Investments LLC and Collbran Vacation Rentals from any legal responsibility if something happens to me, my guests, or our belongings while on or around the property — whether it's our fault, the company's fault, or someone else's.

3. RESPONSIBILITY OF LEGAL CLAIMS

If someone makes a claim or files a lawsuit related to my or my group’s stay, I agree to cover any costs, including legal fees, that Resolute Property Investments LLC or Collbran Vacation Rentals might face because of it.

4. DAMAGE

I agree to pay for any damage caused by me or my group — whether it’s by accident, recklessness, or intentional actions.

5. LEGAL JURISDICTION

If a legal dispute arises, it will be handled under the laws of the State of Colorado.

6. VOLUNTARY AGREEMENT

I am signing this agreement voluntarily and without any pressure. I’ve had enough time to read and understand it, and I know that I can ask a lawyer to review it if I choose. If I decide not to sign, Resolute Property Investments LLC and Collbran Vacation Rentals will cancel the reservation and dissolve this agreement at no cost to me.

7. NO FAVORITISM IN INTERPRETATION AND VALIDITY

This agreement has been fairly negotiated. If any part of it is unclear, neither side will get an advantage just because they did or didn’t write the original wording. If any section of this agreement is found to be invalid or unenforceable, the rest of the agreement still applies.

8. DISPUTES

If there’s a disagreement, both sides agree to first try to resolve it through calm and respectful conversation. If that doesn’t work, we’ll try mediation with a neutral third party who will help us reach a fair agreement. If mediation doesn’t work, either side is free to explore other legal options allowed by law.

I HAVE READ THIS DOCUMENT AND UNDERSTAND IT.  I FURTHER UNDERSTAND THAT BY PLACING A RESERVATION, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS AND AGREE TO THE TERMS IN THIS LIABILITY WAIVER.
